"Yangtze Harmony": The Practical Effects of Enforcing Arbitral Awards In Rem

In shipping law, in rem proceedings are unique in that a claim may be brought against the ship itself, rather than against the owner personally - allowing the ship to be arrested as security for the claim.

Earlier this year, the Singapore High Court in The "Yangtze Harmony" [2026] SGHC 3 confirmed it can lift a stay of in rem proceedings in favour of arbitration. This means an award holder can return to court to enforce the award as a judgment against the ship or its judicial sale proceeds.

How are arbitration claims against ships usually enforced in Singapore?

In shipping cases, claimants often arrest a ship as security while the dispute proceeds to arbitration, with the court proceedings stayed in the meantime. Arbitration awards are ordinarily enforceable only against the named parties (in personam). Yangtze Harmony now allows an award holder to enforce directly against the arrested ship - crucial for claims against one-ship companies, where the ship or its sale proceeds may be the only meaningful asset.

If a ship is sold, where do bunker claims rank in getting paid?

The decision eases enforcement but does not change how sale proceeds are typically distributed. Higher-ranking claims, such as Port dues, Sheriff's costs, and secured claims, are paid first. Bunker claims typically rank as statutory liens near the bottom of the priorities ladder, sharing what remains with similarly ranked claimants. A supplier may not learn of higher-ranking claims until after arrest or sale, by which point little may be left.

Can bunker suppliers improve their chances of getting paid?

Courts can alter the ranking of priorities only in exceptional circumstances, but this is a threshold that unpaid bunker-claims rarely meet. Yangtze Harmony clarifies enforcement but does not guarantee recovery. Suppliers should carefully weigh the likelihood of recovery before arresting a ship.
