Jonathan is a commercial dispute resolution lawyer, adept in both litigation and arbitration, as well as employment law matters. His practice encompasses every facet of the dispute lifecycle, from offering strategic advice in early stages of the dispute to securing interlocutory and injunctive reliefs, preparing for trial, and managing enforcement and appeal processes.

Jonathan has successfully managed a broad spectrum of domestic and cross-border disputes, including commercial fraud and asset recovery, shareholder conflicts, breach of directors’ fiduciary duties, general contractual disputes, insolvency issues, and matters related to employment, insurance, and shipping.

Jonathan is fluent in English and Cantonese. He is qualified to practise under both Hong Kong and English law.

Experience / Representative Matters

Commercial Disputes

Successfully assisted in obtaining 2 arbitral awards in favour of a multinational bank in two concurrent arbitral proceedings conducted under HKIAC rules. The dispute concerns the breach of facility agreement for a loan facility that is in excess of US$300 million.

Successfully assisted in the recovery of funds for a Singapore and Australian company arising out of a fraudulent email scam.

Assisting a Swiss commodities company resist an injunction application in the Hong Kong High Court to restrain the presentation or issuance of a winding-up petition in respect of a CIETAC arbitral award.

Acted for an insurer in a dispute concerning the alleged loss of cargo valued at over USD 2.6 million under marine cargo insurance policies.

Employment

Advised a European manufacturing company and a US headquartered company in Labour Tribunal disputes, including formulating a strategy on defending the claims and drafting defence submissions and witness statements.

Advised a former Senior Vice President of a global recruitment specialist and executive search firm on Labour Tribunal disputes, including but not limited to advising on the merits of employment status and claiming employee entitlements under the Employment Ordinance, drafting submissions and witness statements.

Advised a US headquartered company on the termination of an employee and calculation of termination payments.

Assisted employers in drafting and reviewing employment contracts, employee’s handbook and company policies.

Shipping Disputes

Acted for a shipping company in an arbitration conducted under LMAA rules with a 5-day hearing held at the HKIAC. The dispute concerned the alleged breach of a Bareboat Charter Agreement due to alleged defects on the vessels at the time of re-delivery.

Partnership and Company Disputes

Assisting in the conduct of various High Court actions for a partner of a Mozambique mining business to recover assets of the partnership and in an unfair prejudice petition against a shareholder and other related parties, with claims in the partnership action being in excess of US$200 million.
